Abstract

Inadequate management of solid waste and poor urban cleaning, associated with precarious drainage and stormwater management services represent costs to public coffers, but also to the well-being of the population, since they deteriorate the quality of life and the sustainability of natural resources. Among the numerous aspects of this notably multidimensional problem, this research is concerned with the difficulty of establishing regulatory processes for services whose effects generate benefits and costs beyond their users. The research is motivated by the difficulty of planning, monitoring and controlling regulatory processes for public policies and services related to Federal Laws No. 12.305/2010, known as the Solid Waste Law, and No. 14.026/2020, which establishes the new legal framework for basic sanitation. The overall objective is to establish a flow of information and decision-making that allows optimizing the actions of a regulatory agency, thus contributing to the agency fulfilling its role, including those related to such environmental problems.The partner institution is the Public Services Regulatory Agency of the State of São Paulo (ARSESP), given its competence in the regulation and supervision of basic sanitation, which includes drainage and solid waste management. It is, therefore, a proposal that is part of a public policy process under construction, directed to the management process to be appropriated by ARSESP. The scientific contribution materializes in the organization and analysis of public management databases, generated through the application of mixed techniques, qualitative and quantitative, to data from primary collection, with documentary analysis and in-depth interviews that, evaluated and interpreted through content analysis techniques, generate indicators to support decision making, ordered through multicriteria analysis. Providing historical data, conjunctural information, access and contact with companies in the DMAPU and MSW sectors and non-confidential information on agreements with municipalities for the regulation and supervision of the Public Service for Urban Solid Waste Management (SMRSU) are part of ARSESP's counterpart for understanding the management processes of the public policies involved. Scientific knowledge and plural methodological strategies are combined with the experience of the partner institution's team to establish new regulatory guidelines for drainage and urban stormwater management (DMAPU) and integrated management of Urban Solid Waste (MSW). The participation of a team with experience in the interlocution between the public and private sectors is a distinctive factor of the proposal, combining experiences from academia and the business sector. The collaborative effort contributes to the construction of performance and monitoring indicators that favor the improvement and enhancement of the Agency's regulatory and supervisory activities, as well as the quality of the work carried out by service providers and, thus, the well-being of the population.
