Technology transfer from university: management and new business based on experiences from Europe

Abstract

The growing role the third mission on contemporary university has been assuming in promoting scientific, technological, and, besides that, also regional and technological development in addition to their "traditional" missions related to teaching and research. This means that, among its fundamental missions, in addition to forming highly qualified human resources, it is up to the university expand scientific knowledge in frontier areas. In this context, the third mission of the university assumes importance, as a mechanism for diversifying the relationship with society, as well as providing greater sustainability to public policies aimed at promoting technological innovation. However, the institutionalization and formalization of these relationships between the university and the private sector, especially in federal public universities, has imposed several administrative changes and modernization of its management. One of the greatest challenges for the technology transfer from universities patents to the needs of society, in its various modalities, by the private sector, consist in homogenizing the laws, considering the specificities of the industrial property legislation of each country. The Brazilian Industrial Property Law (LPI - Law 9.279/1976) shows several convergences with French law, which demonstrates the need for greater understanding of the legislation of the countries of Europe. Allied to this, the mechanism of creation of companies of university origin, the spinoffs, has been adopted as a mechanism of transference of technology. For this reason, this research project aims to conduct an exploratory study on the main characteristics of intellectual protection and technology transfer that have been adopted 13y TTOS (Technology Transfer Offices) based on Europe, given the specificities of the legislation of this region, with a priority focus on the understanding of creation spinoffs. To fulfill its objective, it is necessary to carry out training in the TTO of the University of Porto, based in Portugal, that although it was created only in 2004 already presents several companies spinoffs. The results of the research may support Unifesp in the promotion of its strategy of technological entrepreneurship since it does not have preliminary initiatives or studies in this contribution. (AU)
