Abstract

The objective of this research is to analyse the impact of Pope Innocent XI brief of 1681 on trials of the inquisitorial tribunal of Lisbonin cases of solicitation.The brief of 1681 was oriented to the Portuguese Inquisition, establishing some procedures in an attempt to establish procedural doubts placed on inquisitorial processes in cases of crypto-judaism.That legislation was at the end also used in the trials of solicitation (the act of solliciting sexual favours by the priest durign the sacramental confession). Offense of faith, but also considered a crime, sincethat sacrament was an important instrument of social discipline of Modern Portugal.Thus, the analysis of this brief, along with the processes of the tribunal, based on a supporting bibliography, will help us to understand in which way the legal discourse was experienced in procedural practice. We will thus describe the place occupied by this brief in the institutional procedures of the Portuguese Holy Office and its implications in cases of solicitation.
