Abstract

The fundamental research question that this project submitted to the Research Internships Abroad (BEPE) program seeks to answer is to what extent and under what circumstances and conditions Brazil, Mexico, Colombia and Peru have complied with the recommendations and rulings of the Inter-American Human Rights System concerning the issue of transitional justice in the period between 2000 and 2010. In this sense, the investigation will assess how the pronouncements of the Inter-American Human Rights System have been affected in their internalization and also in their impact, more generally, by the these countries' domestic politics, assuming that two conditions are necessary for compliance with transitional justice: first, the existence of domestic NGOs familiar with the legal discourse of International Human Rights Law and that prioritize strategic litigation actions and legal leverage of norms; and, second, the existence of domestic Judiciaries that are receptive to the international human rights normative structure and, in particular, to the jurisprudence of the Inter-American Human Rights system.
