Changes in childhood and adolescence field in Brazil marked the 1990s. The Statute of the Child and the Adolescent represented an important rupture in this field, especially at the treatment the adolescents in conflict with the law and guarantee their rights. Nevertheless, competent agencies must observe the violation of rights these adolescents fulfilling socioeducational measure of internation, for example the permanence of torture and corporal punishment. This study considers the parameters that define the treatment of these adolescents and the contradictions that present in its practical application, as well as the permanence of practices that are at odds with the new legislation. The objective is to investigate the impediments to the consolidation and the expansion of rights, especially the right to education of adolescents in conflict with law, from the period which the socioeducational measures were thought for formation of citizens through the educational actions.
