Abstract

This project involves a case study of plea bargain in Brazil, especially of the process of its implementation, the ways in which it has been used and the disputes surrounding it. The analysis will take in account the practices and positions taken by members of the Federal Public Prosecutor's Office in the context of enforcing anti-corruption law. The fundamental hypothesis of this research is that the disputes surrounding this judicial tool are parts and expressions of the process of developing power-holder legitimacy. Therefore, the research also investigates the development of democracy and Rule of Law in Brazil. This study is theoretically and methodologically informed both by the thesis of discretion and legitimacy applied to the criminal justice system. This investigation will be supported mainly by documentary research. As a result, it should be able to provide a comprehensive analysis of plea bargain in Brazil, covering themes such as the development of its specific configuration and how that impacts the Brazilian democracy and system of law.
