Abstract

The objective of this project is to identify the constitutionalization of rights that emerged from the 1970s onwards in the wake of the so-called identity politics and relate them to the family of social and economic rights. The research is divided into two stages: (1) defining, through literature review, the set of identity rights; (2) empirical analysis, based on data from the Constitute and the Constitutions Analysis Portal, of how these rights were historically constitutionalized; (3) establishing the position of these rights in relation to social rights and their application in the Constitutional Social Score Model (CSSM) framework. Initially, we select as identity rights those related to race (skin color), gender, sexual orientation, and indigenous peoples. This research constitutes a relevant subject for the field of constitutionalism and human rights, as well as providing an important contribution to the Young Researcher (JP) project to which it is linked.
