Abstract

The advancements concerning the protection of women's and elderly rights, despite being significant, prove partially incapable of preventing the continuity of patriarchy and ageism institutionalization. Elderly individuals are frequently victims of violence in Brazil, as are women. Furthermore, when analyzing the violence suffered by elderly women in Brazil in isolation, such as domestic violence, the absence of specific legislation addressing age-based violence is observed, along with aggressions and violations related to gender and the role of women in society. Thus, despite the heterogeneity within this group, for the application of existing legislation, it becomes necessary to classify them under one of the two factors, while the other is disregarded.Therefore, based methodologically on theoretical analysis of gender studies, on the mobilization of law, and the judicialization of counter-hegemonic demands, this study seeks to analyze the responses given by the justice system to the demands of the female elderly population, particularly victims of domestic violence, determining whether the methods adopted by the Brazilian judiciary system are materially effective or if the allocation of competencies and the application of laws, considering separately the condition of being a woman and being elderly, only function as palliative measures in resolving violence and protecting the rights of this group.
