Abstract ABSTRACTThe objective of investigation is to analyze if the principle of the primacy of the most favorable standard to an individual has been employed in the sentences and "advisory opinions" uttered by the European and Inter-American Court of Human Rights. This research will be carried out through of checking dogma, jurisprudence, advisory opinions and procedures from these courts. To reach the proposed finality will be studies the American and European Conventions of Human Rights, the statutes and procedure rules of the Inter-American and European Courts of Human Rights, in addition to the judgments, decisions and advisory opinions for these courts cited above. The data will be obtained by research from Internet, seeking from the electronic address of Inter-American Court of Human Rights and European Court of Human Rights, along with scientific specialized journals in this area, as well as in the bibliography on the subject. | |
