Abstract

The research aims to study further the two rules in question (Escrow and homestead exemption) with attention the history of the rules, concepts, characteristics, and application in the legislation. Once it had studied, the researcher will try to visualize how they are being applied by Brazilian courts, which in its judgments, cross both rules, distorting them from the initial purpose for which they were created.
