Abstract

According to the 1988 Federal Constitution in Art . 196 , it is the duty of the state to ensure access to health care as a social right, through the development of social and economic policies by the state ( BRAZIL , 1988). Diabetes mellitus is a chronic disease that is now considered as public health problem worldwide, chronic complications of diabetes are due to an ineffective disease control, which makes the ways to control this costly. Thus, public policies that provide access to the medicines that minimize the emergence or worsening of the disease, has as objective the reduction of the related costs of acute and chronic complications related to the ineffective management of Diabetes Mellitus (Santos, et al. 2011). Due to the high costs incurred on treatment for control of Diabetes Mellitus, and due to the difficulty of access to inputs available for treatment, users Subcutaneous Infusion of Insulin Continues (ISCI) or insulin pump, turn to the Regional Health Department or City Health Department, in order to guarantee the rights established by the Constitution of 1988. Descriptive and exploratory study aiming to analyze individual lawsuits to supply insulin pump users of SUS with diabetes mellitus (DM) in Regional Department of Health XIII (XIII DRS) of the state of São Paulo and the Municipal Health Department of Ribeirão Preto/SP, during the period of 2008-2012.
