Abstract

The public service concession practices have been gaining ground over the past decades, allowing many agreements between the public and the private sectors. The reasons for this stance are linked to even more distant-time events since the expansion and contraction of the national road investments, and by liberalizing proposals discussed in the Washington Consensus in 1990. What we found was to change the role of the state, acting now as regulator and not as a provider of some services through privatization, concessions and more recently by the so called PPPs (Public-Private Partnerships). In the State of São Paulo, since Governor Mario Covas administration, a concesion program has started, which has already granted permission to 20 road administration companies to operate, a number that will increase in the coming years. However, with the advancement of the private sector in the provision of certain services, we can observe territorial implications of these practices. For concession highways of São Paulo, there is a distribution of revenue from the tolls in the form of tax, Tax Over Services. This is intended in part to the state, as well as to municipalities with stretches of tolled roads in its territory, thus creating privileged regions. For larger municipalities the transfers do not represent a high percentage in municipal tax revenue. However, for smaller municipalities it is a significant amount. The analysis of these implications, as well as the role that each agent takes are the main points of this research.
