Abstract

It is not new place to say that aging has become a phenomenon in relation to the world population. Age in this century does not mean something exceptional since the number of people older is growing rapidly around the world and new demands in different sections are necessary. In this sense, the Public Ministry (PM) is one of the sectors responsible for enforcing the rights of the elderly and it can promote survey civil14, which is an appropriate procedure to ascertain the existence of possible offenses to the rights of the elderly, raising evidence and pointing possibly responsible. After verification of the violation, it may promote public civil action aimed ultimately protect the interests of the elderly. Objective: To investigate the role of prosecution in the face of demands concerning the rights of the elderly in a district of a municipality in São Paulo state. Methodology: This research is descriptive, exploratory, retrospective, based on documentary study of their fundamentals. The analisys will be based in the content fundamentals, in the analised documents, by the theoric referencial about the subject. Expected results: Are based on identifying and analyzing the procedures with the PM about the violation of the rights of the elderly, verify what rights was violed and identify possible correlations about the violence against the elderly and the heterogeneous characteristics of aging in relation to this violation.
