Abstract

This research intends to investigate the relation between international norms of human rights and sovereignty in order to develop a proposal for a model of global constitutionalism. Understanding that the international discourse on human rights has increased since World War II and that we are living in a moment of profound interrelation between States, I intend to discuss the existing options for the development of a democratic international legislation to protect those rights. Considering the current situation of international human rights organizations and regimes, I argue that, on the one hand, it is necessary to rethink the models of sovereignty in order to have enforcement of these norms, but on the other hand, to ensure the defense of the idea of equality of sovereignty in order to avoid movements of occupation and intervention in countries by other States or by international organizations.
