Abstract

This thesis intends to submit data extracted from the case-law of the Brazilian Federal Supreme Court (STF) about the concept and indemnity of moral damages after the promulgation of the Brazilian Federal Constitution of 1988. The study will take place through empirical research that has as its object the set of judgments of the Brazilian Supreme Court between 1913 and 1989. Once this data collection is concluded, the research will systematize the treatment of jurisprudence to moral damage in that period. The hypothesis of the work is the demonstration that, before 1988, moral damage was recognized by case law as indemnifiable autonomously. (AU)
