Abstract

This Research Project has the objective of promoting and achieving a deeper theoretical knowledge of the legal dogmatic of administrative activity in the field of biosafety and genetically modified organisms (GMOs) in the light of the charges of normative constitutional, legal infrastructure and legal force.The research will center, within the scope of Sciences social matters, in the analysis of state activity that in the light of Juridical Science. We focus on the exercise of administrative functions over the National Technical Commission on Biosafety, starting a legal-dogmatic concepts themselves of Public Law, especially in Constitutional Law, Administrative Law and Environmental Law.State intervention in the regulation of the activity is based on Article 225, sections II, IV and V and the first paragraph of the Constitution and in Federal Law 11.105, 24 March 2005 and Decree No 5591, 22 November 2005.We want to deepen existing knowledge of the administrative activity in order to contribute to the understanding and dissemination of legal constraints imposed on the state, when exercising their administrative powers in the application of constitutional principles and legal rules disciplining of construction, cultivation, production, handling, transport, transfer, import, export, storage, research, marketing, consumption, release into the environment and disposal of genetically modified organisms - GMOs and their derivatives.
