The correctional punishment of the minor (1840-1930)

Abstract

The project entitled The correctional punishment of the minor (1840-1930) is based on an interdisciplinary methodology of historical legal character that aims to consolidate the research line History of Law and Childhood and Youth. The project is situated in the broad concept of "correction" that has undergone major mutations throughout history from the emendatio term of Roman law. For the period indicated, this concept lies in the theorization of collaboration between family and state to correct unruly conduct and thus prevent potential delinquency. The aim is to test the applicability of these theoretical and conceptual frameworks in Brazilian law from 1840, the period called Second Reign, until the end of the First Republic, in 1930. Field research, supported by primary sources, will be carried out primarily in the USP Institute of Brazilian Studies, which concentrates an extensive collection (legal works, law collections, jurisprudence and parliamentary debates) and, in a complementary manner, at the Library of the Faculty of Law of USP and the Public Archive of São Paulo. It will also be necessary to consult the National Archives and the National Library. The main objective is to understand the legal and institutional treatment given to minors from three projections of minority: minor in civil sphere, minor in criminal sphere and minor in state tutelage institutions. The expected results consist in the development and consolidation of the History of Law area at the USP Institute of Brazilian Studies, with the creation of a research group, and the production of knowledge in research, teaching and extension.
