Abstract

The research aims to investigate the legal regulation of the fundamental right of communication guaranteed by Brazilian Constitution. The current Brazilian Constitution has substantial character as it stipulates numerous purposes, goals and values that the Brazilian State and society should realise or at least strive for. One of these values was the right of communication. Also for the judicial power was assigned the function of realize rights. To lead the project scope will be revisited the constitutional process to investigate what was intended by the constitutional regulation for the right of communication, as well, will be investigated the legal interpretation and implementation of these rights by the Federal Supreme Court, through the analysis of judged delivered by this this Court in constitutional actions relating this fundamental right.
