Searching the leisure constituent: its inclusion as social right in Brazilian Constitution of 1988

Abstract

The leisure is defined in the Constituição of Brazil of 1988 as one of social rights; this tells us that he was considered the time of construction of this constitution, essential to the citizens and their welfare. The social rights are achievements of workers, it are understood as constructions due to multiple conflicts and interests. However, the place occupied by leisure and understanding around him in Brazil, at the time, are quite different that place occupied by social rights and the nature of such rights. The leisure was seen as something superfluous, secondary, which was not reclaimed, showing an all contradictory about its inclusion as social right in the Constitution of 1988. This research sought to reconstruct the history of leisure in constituent to understand how e why it was included in Brazilian Constitution of 1988, which the political actors and interests involved, and meanings and understandings of leisure, within the process of building such constitution. Thus, the corpus documentary privileged in this research consist of documents produced by the Constituent Assembly of (1987-1988), and the documents that were produced around it. The traces found showed that there was no popular organization, lobbying and interests about the leisure, but also revealed that leisure occupied a prominence place in the lives of Brazilian citizen, as evidenced by the status of right conferred on it by three different actor participating of constituent people, organizations and constituents.
