Abstract

More than analyzing normative texts written in the political documents of a country, it is also a duty of the research in constitutional law to perceive the practical mechanisms that determine the concretization of those texts, so that the discipline can contribute to a broader and deeper comprehension of the relationships between society, State and the law. Institutional, cultural and social elements transform a law text into live norms that compose the reality. Thus, the scholars that write constitutional law works are also responsible for the construction of the law. Therefore, aiming to reconstruct aspects of the Brazilian legal tradition, this work will analyze how constitutional law books published between the end of the 19th century and the beginning of the 20th century influenced the legal, political and institutional configurations of the Brazilian first Republic.
