Abstract

The main focus of this paper is to determine the efficiency of the existing legislation in Brazil, to prevent and repair damage resulting from oil.This project aims to compile the studies on possible environmental impacts of oil activities, studying the methods of mitigation or elimination of possible damages. It will be studied the mechanisms of control of pollution through environmental impact assessments and environmental licensing, whose foundations are in the Federal Constitution. Besides the instruments to prevent possible environmental damage from oil, the legal liability arising from the exploration, exploitation and transportation of oil, both in domestic and international law, will be object of analysis. The project aims to monitor the technological innovations in this sector, and where such innovations are likely to lead to a reshuffling of the current legal framework, recommend possible changes in legislation.
