Abstract

State participation in the economy and the production of social goods and the size of its bureaucratic structure and services have occupied much of the concerns, discussions, and proposals for reform on the part of public and social agents. For years the administrative and financial autonomy for the management of public establishments is important in the public health agenda in Brazil and abroad. In this sense, have been created different legal personalities in the country, with emphasis on Social Organizations (OS), under the federal government, and their correlates, Health Social Organizations (OSS) in São Paulo, where they manage now, 37 hospitals and 38 clinics. Its defense is guided by more efficient management, with a significant increase in autonomy and flexibility compared to direct administration by the State. On the other hand, the OS constitutionality is being contested for years and they are regarded as a model that would lead to privatization of the health system and the weakening of labor ties, as well as critics for its low permeability to social control. This project is a theoretical study on the OS and a performance evaluation model of OSS in the state of Sao Paulo in 2011 from its financial reporting and execution of contracts that shall be published in the Official Gazette of the State, and also their Management Reports. The aim is also to review its historical construction as a proposal, addressing its legal and labor-related aspects, the criticism of the model, the State's role in providing health care to the population, and a comparison to the international scenario.(AU)
