Abstract

A great landmark in the regulation of the Roman corporations is the Lex Iulia de collegiis, which would have submitted the creation of any associations to the previous authorization of the Senate or the Emperor. Hence, a common statement is that this authorization also gave them legal personality, differentiating, thus, the corporations themselves from their members. We aim, therefore, to analyze the possible ways of conciliating the patrimonial separation given by the Lex Iulia de collegiis, with the full payment rule, when the corporation's assets were not enough to cover its debts, verifying the possibility of the application of beneficium competentiae, as it happened with the societates and, especially, with societates publicanorum, also the collegia. This way, our goal is to undertake, for twelve months, a Research Internship in Germany, in one of the most relevant research center, which is, Leopold - Wenger - Institut für Rechtsgeschichte (Abteilung A - Antike Rechtsgechichte und Papyrusforschung), belonging to the LMU.
