Abstract

As already outlined the contradictory aspect of Freudian moral - whereby the inner law is presented as being divided in its aspect pulsional on one hand, and censor, on other hand -, our research follows intending to expand what would be the morality of such characterizations in their philosophical and legal questions. Therefore, we will deal with the opacity surrounding the transgression and obedience to the law, which appears to us as categorical, excessive and arbitrary as it is paradoxical in its content. If in any case we are guilty, both obedience and transgression of the law are equivalent, the offense that persists within the law being what organizes the subject. In addition, the moral law appears as unconscious, as it is mediated by feelings related to the authority figure that holds the law in its symbolic meaning and therefore organizational. Following this, we question about what is individual in the moral formation of the subject and we realized that there cannot be a distinction between autonomy and heteronomy as the modern definitions of the subject in relation to social, as otherness already appears from the beginning constituting it. What we perceive is, rather, a moral that judges subject considering a run which does not distinguish its characteristics that could guide the application of the rules. However, we can still talk about a boundary identification in the socialization process of individuals that makes them endowed with different relationships to the law. It is this relationship that we want to figure with the analytic situation of "negative therapeutic reaction" as a way of displaying confrontation with the law that is on the border of the legal rule of hyper-morality, examples of moments when the subject turn up their sense of the moral rule.
