Abstract This research aims at comprehending the relation between culture and human rights in regulatory production on cultural policy, specifically in the 53rd and 54th legislatures in the Brazilian National Congress, as well as understanding the impact of this production in establishing cultural rights and in public policies for the promotion of cultural diversity. For this, we shall conduct a documental and bibliographic research in order to report on legislative proposals in progress which refer to institutionalization and regulation of cultural policies within an established period of time, by analyzing the concepts of culture that have been adopted and the spaces dedicated to cultural diversity. The starting points will be the law that instituted the Plano Nacional de Cultura ('National Culture Plan') and the constitutional amendment proposal of the Sistema Nacional de Cultura ('National Culture System'). The hypotheses raised in the research question the effectiveness of regulatory frameworks in the establishment of the cultural rights assured by the Brazilian Federal Constitution of 1988 and in the fostering of cultural diversity.
