Abstract

The change of name and "sex" in civil identifications having as motive the belonging to another gender identity (and not to the one in the document) is not something due to the Brazilian law. Facing this legislative gap, it is up to the Brazilian Courts, represented by judges, to decide lawsuits (initiated in majority by transexuals) about this theme using ampler, more general existing rules. This present research intends to analyze the discourses and representations transmitted in these judicial decisions, giving attention to the construction of extralegal categories such as "sex", "gender" and "transexuality", the arrogations and reinterpretations of legal documents and the way the State produces and exercises power by the act of writing.
