Abstract

The change of name and \"sex\" in civil identifications having as motive the belonging to another gender identity than the one in the document is not something due to the Brazilian law. Facing this legislative gap, it is up to Brazilian State Courts, represented by judges, to decide lawsuits (initiated in majority by transsexual people) about this theme using ampler, more general existing rules, customary behavior and case laws. This dissertation is about the discourses transmitted in these judicial decisions based on a research made on all State Courts websites databases and on the Judiciary Power Archive of the City of São Paulo. My objective is to analyze the construction of extralegal categories such as sex and transsexuality; the articulation with biomedical knowledges; the appropriations and reinterpretations of legal documents; and the establishment of norms and limits to political subjectivity specific to transsexual people through the exercise of State power by the act of writing.
