Abstract

The main objective of this project is to analyze the socio- legal conflict between the assurance of cultural rights to the traditional extractive and limitations on the use of nature as a result of the Public Policy " green bag " in the Extractive Reserve Mapuá - PA . The central research question pervades the need to think about how the right is or should be guiding the conflicts raised the apparent conflict between land use and nature conservation . Information gathering will be held from semi-structured interviews , individual or collective , taped and / or recorded in a field diary , being understood from an understanding concretist the legal phenomenon , in which the recovery of the norms of justice is embedded in practices customary observed , seeking local understanding of the restrictions imposed . The study will use methods : a) deductible in order to get communities the axiomatic principles of justice , and b ) " progressive-regressive " , in order to combine the case study in depth the findings of fact in the general context . Justified this project , the need to envision possibilities for a dimension that goes beyond notions of the right legal pre - determined and to understand how the legal landscape positive can support both the " visibility " and the "invisibility " of traditional peoples in the midst public policies implemented with objectives of securing rights from the perspective of universality .
