Abstract

The innovations introduced into the Brazilian legal framework and the political pressure made by urban democratic movements demanded the revision of the role of public administration. Initially implemented at the local level by progressive administrations (since 1990) and then at the federal level (since 2003), this revision included a democratic restructuring of the institutional framework to accomplish the role of the state in promoting fundamental rights. Within the urban policy, however, significant barriers hampered the effectiveness of the urban reform agenda, such as regarding the management of federal property. Despite the changes in the institutional apparatus, in the legal framework and in the management model - arising from the review of the concept of public property adopted by the Secretary of the Federal Heritage from 2003 - these were not sufficient to promote a shift in the logic of allocation and land management of the federal government' property. This does not mean that there were no changes. While acknowledging the importance of the merits achieved, especially in the field of recognition of rights, this research project supports the hypothesis that aspects mainly related to urbanistic issues and to political, legal, administrative and notarial culture - both at local and federal level - were crucial in preventing further progress in fulfilling of the social function of the federal government' property.
