Abstract

The objective of this research project is to situate the constituent process and the Constitution of 1988 in the modern international scene. I selected cases of constitutions and constitution-making from different countries that are similar to the Brazilian case regarding the detailing level of the labor and social rights, especially, in the Education and Health areas. Through the comparison of the selected cases, I will test a hypothesis developed by the Political Science regarding the link between process (the constitution-making) and outcome (the constitutions). The hypothesis supports that constituent processes with a high level of public participation, including the performance of pressure groups, result in long and detailed constitutions. (AU)
