Abstract

This study will investigate the effect of the Brazilian thin capitalization rules in the Brazilian multinationals' capital structure comparing to conventional companies. Official data point to changes in the inflow of costly resources in the country, compared to those for capital investment. These resources generate interest expenses, deductible from the calculation basis of income tax. The Brazilian government, in order to regulate this practice of tax planning and reduce the decrease in tax revenue, has issued rules for intercompany loans contracts. This tax planning tactic has been investigated in other countries in Europe and in the United States and results show the effectiveness of the rules and some evidence of corporate behavior facing this kind of regulation law, like the substitution external funding for domestic financing. This project will investigate, through the use of the experimental method and qualitative technique of comparative analysis, the effect of the Brazilian law on the capital structure of Brazilian companies with units abroad, seeking both to contribute to the knowledge about the effectiveness of the Brazilian standard and for those related to capital structure theories.
