Abstract

This paper aims to reflect the institutional protection offered to sex workers in Franca, where victims of sexual violence, specifically, about the rape. Note that the applicability of the incriminating standard of rape involves judgment not only of the facts, but also of morality and sexual reputation battered woman, who fails to take up the role of victim to become a potential suspect. Cases of rape are exploited by practitioners, working to control female sexuality and prevent the exercise of his work from the freedom and autonomy. Therefore, will be questioned criminal selectivity of women ranging from the stigmas of victims and villains, as well as the aggressors, labeled by class criteria, gender and race / ethnicity. In view of the questions formulated by the Feminist Criminology, the critical theory of human rights and also by the Transnational Feminism, this paper aims to deconstruct the structural sexism present in all social areas, including in the legal imagination. Finally, the research could lead to the alternative formulation of alternative policies to combat sexual violence in order to ensure a free and dignified life for sex workers, especially in relation to rape.
