Abstract

This research has as study object the set of contemporary institutional rules of urban policy in Brazil, since the promulgation of the 1988 Constitution to the present day. The choice of Constitution as a landmark, is justified by its originality and because it contains the fundamental normative principles of an innovative policy inspired by the urban reform that also demarcated the subsequent infra-constitutional legislation. This investigation will be performed by producing a quantitative inventory and qualitative analysis of the principles, rules and legal requirements that redefined the state's role in the public policy ground .The chronological cut, however, includes a brief preliminary reference to the decades of 1970-80, increased period of social struggles against the military dictatorship that gave emphasis on urban issues in the political arena and then led to the Popular Amendment for Urban Reform to process constitutional. On the quantitative level, a comprehensive catalog of institutional innovations produced in the selected period will be produced, taking as main sources of consultation Congress (Senate and House of Representatives), the Federal Supreme Court (STF) and the Ministry of Cities, as well other government agencies also responsible for public policies in the field of urban development. Based on the data sources available and the corresponding thematic bibliography, the qualitative balance of the results will be interpreted by critical analysis of the normative principles, the implementation and the potential effectiveness of such rules in the implementation of urban policy in the contemporary period.
