Abstract

This research proposal aims to evaluate the institutional framework of public policies on urban planning in contemporary Spain, taking as analytical reference the Planes de Ordenación Urbana. The research requires the cataloguing of political-institutional model and the constitutional provisions that regulate urban policy and its respective legal framework; the production of an inventory of the infra-constitutional legislation related to urban policies, focusing on land use planning, the regime of occupancy and using land and devices of share; the analysis of the specifications and scope of Planes de Ordenación Urbana as a privileged instrument of regulation of urban policy in the core of the broader regulatory framework; and an analysis of the scope and effectiveness of the democratic participatory mechanisms of Planes de Ordenación Urbana. In addition to the normative content of urban policy, the research project will also emphasizes the main features and factual implications of existing urban policy models, so that we can sketch an overview of the "state of the art" and trends of urban policies in Spain. Based on the theoretical references and research sources, a study will be done about the Planes de Ordenación Urbana according to their institutional base, scope and effects of regulatory standards and their participatory devices will be interpreted. Finally, under an interdisciplinary approach that involves theoretical and methodological references of urban planning, political science, urban sociology, geography and urban law, it will be developed a general comparative overview of the institutional framework of urban policies in Spain and in Brazil in the contemporary period.
