Abstract

The present work is intended as an analytical study of Michael Sandel's work and its critical project against the egalitarian liberalism of theorists such as John Rawls and Ronald Dworkin. Its guiding themes are the liberal conception of the subject, the liberal conception of community, liberal antiperfectionism, the alleged inadequacy of a deontological theory of justice, and the problems that the theory's defects show in the practice of a contemporary democratic society. The study's central hypothesis is that Sandel's work contains three unsurmountable problems: 1) the lack of a theory of rights that clearly describes how a teleological theory of justice would take place, in regard to the protection of minorities and democratic participation, features that Sandel explicitly endorses; 2) the confusion between the political and the collective, as if everything that extrapolates the purely domestic domain inevitably became the State's domain; 3) the confusion between political science - or immanent social criticism - and political philosophy or theoretical criticism.
