Public tender and political institutional dynamics: ingress and selection in the careers of public defense and state attorney's office of São Paulo

Abstract

Both the Public Defender's Office and the Public Prosecutor's Office perform functions of extreme political and social impact, with emphasis on the criminal area and the protection of diffuse and collective rights through Public Civil Action. Based on the importance of both institutions for the functioning of brazilian democracy, the reasearch aims to offer a diagnosis of the dynamics of admission and selection for those careers in the state of Sao Paulo, in order to elucidate political-institutional issues and, consequently, to contribute for a better understanding of the functioning and organization of both institutions. To accomplish this task, the following questions were elaborated: (i) How were public tenders structured over time? (ii) With which juridical-political perspectives should the candidate be committed to be selected? (iii) Still, based on the diagnosis presented by the FGV-RIO research, were some of the characteristics presented by the study found in the public tenders that will be analyzed? If so, which ones? The research will focus on documental analysis of the objective tests (multiple choice) and essays of the contests, as well as interviews with three groups of individuals: members of the organizing board, examiners of the oral tests and public defenders and prosecutors who have entered the career since 2003 - date of the first public defender contest
