Abstract

Recently, the concession of public services has become an increasingly common practice. These services, which should be carried out by the State, are transferred to the private sector. Following the guidelines proposed by the Washington Consensus of 1990, the Brazilian governments articulated themselves in accordance with liberalizing practices, going through periods of privatization and advancing to what we currently have PPPs (Public-Private Partnerships).Supported by a discourse of lack of resources and a search for an improvement in the quality of its highways, the São Paulo government, in the management of Mário Covas (1995-2001), started the Concession Program between 1996 and 1998. With this, the implementation of toll plazas becomes one of the most controversial fields of discussion, raising several questions about the breakdown of the right to come and go, a supposed double taxation, as well as the profits achieved by the concessionaires compared to that collected by the Public sector.Also worthy of note is, and a closer look, such as the distribution of revenues from tolls, between concessionaires, the state and municipalities, in order to understand how this current dynamic influences the different spheres. It is also possible to analyze how some selected municipalities end up receiving the transfers on the ISSQN form of tolls, while those that are not close to the toll roads are not entitled to this extra money, creating privileged regions. This resource passed on by concessionaires to municipalities often ends up having a considerable impact on their collection, especially in smaller ones.
