Abstract

The target of the present research is to investigate the problem of the theory of Law and State in the works of Andrei Vychinski in the period of socialist transition in the Soviet Union. The hypothesis is that Vychinski's articulation between Law and State results in a theoretical problem that marks a real break with the tradition consolidated in the 1920s in the Soviet Union, in the field of Law, and with the classical theory of Marxism, in the field of the State. In order to reach the proposal established here, we opted for a bibliographical revision that includes unpublished texts in Portuguese of the author and also texts of Vychinski's main critics, in confronting with the writings of Marx, Lenin, Pachukanis and Stutchka, besides authors that characterize the Soviet formation by the thesis of state capitalism, notably from the works of Charles Bettelheim. What motivates the accomplishment of this work is the link already established by the proponent with the theme from the researches carried out during the graduation, its novelty in the Brazilian scientific milieu, as well as the need to retake the debate on the nature of the Soviet economic and social system as well as the theoretical production of authors such as Vychinski, in order to unveil its real meaning. We hope, from this study, to contribute theoretically to the field of social sciences in general, especially Political Science and the General Theory of Law and State. (AU)
