Abstract

The real estate auction is the legal procedure for repossessing and reselling residential properties whose owners have gone into default. In other words, it is a legal or administrative action that, when repossessing the property, quickly seeks to put it back on the market. In other words, it seeks to restore the flow of payments or recover the amount financed. The legal mechanism that facilitates the repossession and auction of properties is the statutory lien, law 9,514/1997. Even with the existence of a guarantee fund on the part of Caixa Econômica Federal, the main agent for financing housing in Brazil, the resumption and auctions of residential properties have shown an upward trend. Thus, this project aims to investigate such processes, in particular from the year 2019, given the ongoing economic crisis since 2016, generating impacts to date and, more serious, the effects of the health crisis in 2020. Based on the data of auctions published by CEF in the cities of Presidente Prudente and Ribeirão Preto, the price ranges of the residential properties put up for auction, their locations, and other relevant information will be analyzed and the extent to which such processes will be problematized, weakening the lives of families who lose their homes, it implies at the same time the loss of rights and the precariousness of life in cities.
