Abstract

Restorative Justice (RJ) is a model of justice as a multifaceted reality in Brazil and despite the growing discussions, training courses and the development of RJ programs, studies on its application in the country are still scarce. Recognizing the importance of developing these researches, the Phd project nº 2019/14445-0, is developed with the hypothesis that RJ is a process that repositions the conflicting parties in the history of what happened through their narratives, that is, is a negotiation made by the language itself. However, the partial analysis of the data produced so far demonstrates a series of challenges in the practical development of RJ in Brazil, thus, it is necessary to dialogue with the literature and practice of locations that have experience and scientific knowledge in the development of this model of justice. Since 2007, the Basque Country, Spain, has had RJ programs implemented in the region and PhD Gemma Varona Martínez is investigating this development, being a permanent doctor at the Basque Institute of Criminology, coordinating the research line Victim Justice and Restorative Justice, of the Research Group in Criminal Sciences at the Universidad del Pais Vasco, with more than 30 years of experience in interdisciplinary criminological studies, is a world reference in publications on the subject and coordinates the Laboratory of Restorative Justice Theory and Practice of the Basque Institute of Criminology. Replicating the research methodology developed in the PhD project linked to this project, it is hoped that the internship will make it possible to understand if the resources used in conversational processes in RJ in Spain are different from those used in Brazil, to understand how the implementation challenges were overcome, in addition to critically comparing and discussing the results found in Spain and Brazil, so that the exchange of resources and techniques is possible.
