Abstract

Water is an essential good for human survival. This scarce natural resource is distributed unevenly. Access to drinking water depends on technical and financial conditions. In 2010 the United Nations General Assembly recognized access to clean water and sanitation as a human right. However, the universal nature of human rights faces various challenges because of the tension between the multiple uses of this scarce resource. The main purpose of this research is to highlight the key challenges that still prevent the complete implementation of this human right by exploring the thematic studies prepared by the UN Special Rapporteur on human rights to drinking water and sanitation. The proposed research, therefore, is by its nature an applied, exploratory, and descriptive research. It will be possible to assess the main obstacles identified by the Special Rapporteur and the proposed solutions using public documents and Content Analysis techniques. It will be viable to discuss, among others, the theme of governance of the water and sanitation providers. As a foreseen result, the remaining challenges towards the universalization of water and sanitation will be evaluated by comparing the Brazilian experience with that of other countries. Hopefully, the results can contribute to the analysis of the new legal framework for sanitation in Brazil approved with Law 14026/20 of 2020 and its consequences.(AU)
