Abstract

Although home education is not a new topic in Brazil, considering the history of education and the Brazilian constitutions, the debate about its practice has gained more evidence in recent decades. After the last position, in 2018, of the Federal Supreme Court (STF) in the extraordinary appeal 888.815/RS, regarding the non-unconstitutionality of home education in the country, attempts to regulate it at different levels (federal, state and municipal) increased. The main objective of this project is to analyze the conjuncture of forces and legal and political disputes in the process of regulating home education in Brazil and how this movement has affected Brazilian public education. The carrying out of the investigation, with a qualitative approach, will take place mainly through: document analysis (opinions, bills, votes, manifestos, legislation, among others); bibliographic research (including national and international literature on the subject); and semi-structured interviews (with political, judiciary and civil society actors who act and/or acted directly or indirectly in the national regulation process). It is considered that the current search process for the regulation of home education in the country already presents demands to different instances and, once this "modality" of education is approved, the Public Power will have to be responsible for its implementation, and such actions may affect the right to education of children and adolescents. As research results it is expected: to show the forces and actors that are articulated in favor of home education, as well as its consequences for Brazilian public education; contribute to the broadening of the debate on the right to education and the public policies necessary for its viability.
