Abstract

The search for the sustainable development goals of the 2030 Agenda has become increasingly prominent in the national and international context. Among the 17 goals, this research proposes a study centered on achieving the 16th goal "Peace, Justice and Effective Institutions" in the face of the failure of the country's prison system. The decay of the national prison system has an intimate connection with overcrowding, as discussed in the Argument of Fundamental Non-Compliance 347 of 2015 and in the CPI on Prisons, also of 2015. In this scenario, the custody hearing is particularly important as it is a tool to combat overcrowding and crime. Therefore, custody hearings are a valuable national instrument for achieving the 2030 Agenda, as they reduce the population of prisoners without sentences, an indicator set out in target 16.3 of the 16th SDG. For these reasons, this study seeks to delve deeper into custody hearings as a criminal policy, addressing the origin and foundations for building a perspective of the institute in Brazilian society, as well as presenting possible improvements to the device, which is still very recent in the Brazilian legal system, through comparative and international law.
