Abstract

The aim of this project is to analyze Internet access as a conditional right for the full enforcement of other constitutionalized human rights. This objective will be achieved through (1) the collection and systematization of scientific literature on the definition of Internet access as a fundamental right and (2) its relationship with other human rights, as well as (3) the empirical analysis of constitutional documents, constitutionally ratified international treaties and conventions, and infraconstitutional legislation, with the aim of (3.1) mapping the constitutionalization and/or the potential for constitutionalization of this right and (3.2) identifying how traditionally constitutionalized human rights may depend on the Internet as an essential condition for their enforcement. This Undergraduate Research project is part of a Young Investigator Project, funded by FAPESP, under the supervision of the advisor responsible for this proposal, developed at the Laboratory of Constitutional Studies (DataCons), at FCLAr/Unesp. The empirical data that support this proposal are derived from the research conducted by the DataCons team, including the database of the Constitutional Social Score Model (CSSM). The expected outcome of this project is the expansion of the agenda on new fundamental rights.
