Abstract In the modern world, collective bargaining is an essential tool for promoting fairer and more balanced working conditions, giving greater value to work rather than making it merely a source of suffering. This research seeks to analyze and compare collective bargaining in Portugal and Brazil, investigating how cultural and legal differences may influence these negotiations and exploring solutions and improvements to current practices. Thus, the aim of this study is to examine the institution of collective bargaining within the Brazilian and Portuguese labor legal frameworks, the legislative changes resulting from crises and reforms impacting bargaining in these countries, and, from this, to identify Portuguese mechanisms and practices that could inspire improvements in collective bargaining in Brazil. To achieve this, bibliographic and documentary research techniques are adopted as procedural methods, and deductive and inductive approaches are used, along with the comparative method. The relevance of this research lies in the importance of collective bargaining in the modern, post-labor-reform world; a comparative study is essential to develop practices to be shared, aiming at improving working conditions. Successful collective bargaining brings numerous benefits for both workers and employers, contributing to the dignity and well-being of these social actors, making work, finally, a means of fulfillment rather than punishment. | |
