Alcohol use and juvenile delinquency in the city of Ribeirão Preto

Abstract

This research has the general objective to discuss the interdisciplinary dialogue between Mental Health and Law as an hypothesized statal approach to serious offensive behavior of juveniles who use alcohol. The specific objectives are: a) verify the existence or non- existence of an association between alcohol use and the seriousness of the offense committed by the participant; b) verify whether or not an association exists between alcohol use of adolescents offenders and the alcohol use of their parents; c) deepen the analysis of the use of alcohol, to understand points that may contribute to the perception of the participant\'s drinking habits. Having this research an interdisciplinary nature, we opted for an experimental contact to a methodological practical alternative approach, always in dialogue with the classical scientific methodological basis, that being understood here as one in which the participant appears as a passive element of the research. The practice with regard to the context of this research comes down to the observation of juvenile delinquency phenomenon in everyday life, under the critical eye of the jurist following an interdisciplinary academic career. As an interdisciplinary study resource, we used the technique of \"methodical epochè\" proposed by De Wachter (1982). The data collected refer to 480 participants in the city of Ribeirão Preto, registered for offenses, being 458 male participants and 22 female participants. Data collection was conducted through data collection instrument developed by the researcher and the Alcohol Use Disorders Identification Test-AUDIT. From the results, we realize that parents influence their children in frequent alcohol consumption, and peers and boyfriend/girlfriend influence on alcohol consumption in general. In addition, more serious offenses are associated with increased use of alcohol. With additional data about alcohol habits, we noticed that the participants seem to have well-defined preferences and a socialized consumption, both in relation to the local of consumption, and to the companionships. In addition, there are kinds of beverages reported as more often preferred. Other data show that juveniles are to a great extent in contact with situations or behaviors indicative of maturity (sexual activity with a steady partner, marital relationship, children, truancy, driving, buying their own alcoholic beverage). A fact that seems to clash with this situation is the high proportion of participants who are not working. However, with the most common offense being drug trafficking, maybe that\'s the source of money to the participants. Analyzing the results in light of the theory as well as the legislative analysis of the Brazilian juvenile justice system, the exercise of \"methodical epochè\" and reflection on the interdisciplinarity between Law and Mental Health, we have concluded that Mental Health may be presented as an alternative statal approach to juvenile offender who uses alcohol, driving the practice, operationalized by psychiatric nursing, to see the adolescent as an individual in its integrality, ushering a new conceptual perspective in order to insert bioethics in the legal discussion regarding juvenile delinquency (AU)
