Abstract

This academic work is the result of the research done in the Masters Program at the Faculty of Law of the University of São Paulo, under Professor Ricardo de Barros Leonel supervision, who belongs to the Civil Procedure Department. The research was developed during the last three years, which subject-matter is the principles of Civil Procedure when applied to the collective suits - the class actions in Brazilian Law. In order to commence, the first chapter contains a full explanation of the subject, the second chapter covers the different concepts of rules, as principles and laws in their many concepts adopted by the most distinguished authors in the field. Those chapters are important to establish a base knowledge; hence, they showed to be benefic achieving a better understanding of principles in Laws actual situation. After that, the principles of Civil Procedure in Brazil are analyzed, focusing in the Collective Suits, passing by the main institutes of the Civil Procedure, especially those ones assuming a different perspective in class actions field. As the Civil Procedure is organized in a specific method, which follows an order, mainly, we adopted this structure to organize the presentation of the Civil Procedure principles. (AU)
