Abstract

Abstract The liberal conception of civil disobedience, reinforced by the philosophical merits of John Rawls’ approach, has become one of the most influential perspectives on the subject in contemporary political theory. This paper seeks to challenge this hegemonic conception in light of a primarily political and democratically more demanding model, which we will identify as the democratic conception of civil disobedience, prominently expressed in the work of Habermas. Thus, we will argue that democratic civil disobedience offers a potentially more transformative political approach as it allows for the voicing of new emerging demands in civil society, renewed interpretations of justice, a channel for advocating new rights, and an expansion of forms of democratic participation.
