Abstract

To consider a city legal or illegal is a discussion that stems directly from the treatment of the cities social functions, which in the Brazilian state is governed by the Article 182 of the Federal Constitution and also by the Law 10.257/2001. The presented research will look upon the illegality under the light of the non-compliance of environmental planning legislation by public authorities and individuals in the cities of São Carlos (Brazil) and Coimbra (Portugal). By investigating the administrative and judicial proceedings related to these themes, it will be verified, within a period 10 years immediately preceding the beginning of this research, various aspects, aiming to classify cities as legal or illegal. The methodology of this research will be through documentary analysis given by survey of works published on the subject; mapping of judicial and extra-judicial proceedings from São Carlos-SP and Coimbra (Portugal) in the last ten years, access to State, Federal Judiciary and competent agencies databases, and interviews with members of the judiciary and public officials to collect their perceptions of the techniques employed. In this context, this project aims to identify the urban environmental conflicts in São Carlos-SP and Coimbra (Portugal), through an analysis regarding compliance with the rules, in view of the theoretical frameworks regarding illegal cities. And the specifics objectives: the development of a map of environmental conflicts in São Carlos-SP and Coimbra (Portugal), which will be made available on the research website in order to make the access easy to all the possible operators for each urban environmental conflict, providing information and interaction; and the comparison of different instruments for solving urban environmental conflicts and its effects, in order to contribute to the construction of public policies that provide welfare to citizens.
