Abstract

Search to study the process of recognition of Quilombo communities, within the prescribed by Article 68 of the Constitutional Provisions Act Transitory of the Brazilian Constitution. The process carried out by the Brazilian Government has intended to expedite the remnants of Quilombo communities legal title to the collective, guided by the expert anthropological reports. Represents potential access to a right collective character, ethnic and land, which refers to identity, since the constitutional presupposes the emergence of identity maroon, despite the ressemantização the concept, purposes of legal applicability. Aproposal to reflect on the dynamics ofidentities, religious, political and legal, by monitoring a group of ethnically differentiatedtowards the new horizon of rights,demand framework to legal categories, which leadsthe re-design in the community, internally and externally, as a political and social, from the regulation legal identity.The field of empirical observation is the Comunidade do Carmo, located in São Roque, SP, formed by descendants of slaves of the Carmelite Province Fluminense, self-appointed filho de Nossa Senhora do Carmo - "Sons of Only Reza" - which takes place the transformation of the group as the subject of new set of rights.
